An Interesting Test of the 10th Amendment

Up in Massachusetts, an interesting battle is being waged over the 10th Amendment and so-called “States’ Rights”.

Per this AJC article, here’s the basic story:

As some of you know, in 2004 Massachusetts became one of the first States to full-on legalize gay marriage. Under State law there, there is no legal difference whatsoever between a heterosexual marriage and a homosexual one. Obviously, religious groups in the State are free to adhere to different standards, except where they act as an employer.

The problem comes from the fact that there, as in Georgia, many of the citizens are employees of the Federal government – which, per the Defense of Marriage Act passed in the 90s, does not offer benefits to same sex couples.

Therefore, postal workers and other Federal employees cannot place their same-sex spouses on their benefits package, such as employer-provided insurance.

One such couple sued, and a US District Court Judge whose district apparently only encompasses Massachusetts has ruled in the couples favor that the DOMA “interferes with the right of a state to define marriage”.

That quote, in particular, is what makes this interesting politically regarding the 10th Amendment.

Gay Marriage–A Boom To The Economy?

One of the recent MSN headlines read, “Will Gay Marriage Help Rescue the Economy?” The article suggests that all of the new weddings will bring an economic boost to states that allow it. Marriages are expensive, you know.

Unlike my contemporaries at SWGA Politics, I am against gay marriage. Marriage was created as an institution between a man and a woman for the protection of children, parenthood, and families. Two men in a relationship cannot make a baby. I believe that is by design. Ideally children need the influence of both a father and a mother in a family setting.

But sure enough, his recent comments actually echo something I’ve said time and time again: “I think, you know, freedom means freedom for everyone”.

Respecting Miss California

Carrie Prejean, better known to most as Miss California, is under fire yet again.  This time, it’s for photographs that are racy in nature and are being called by several “inappropriate”.  Prejean, the runner up in the Miss USA pagent, has been under fire since her big night, because of her statements about gay marriage.  The details are available on MSNBC.

My position on gay marriage is pretty well documented, including a piece on just such a topic yesterday.  However, my personal position is irrelevant.  This isn’t about me, but about Miss California.  She’s stirred up the proverbial s*** storm with her comments about her personal belief that marriage is something that should be between a man and a woman.  Yes, I disagree with her.  However, I’m going to do something that may surprise many.  I’m going to defend Prejean.
