Rod Jolivette must love making news. Personally, I don’t see anything wrong with that one per se. What I do have a problem with is Jolivette’s method of attracting attention. In this case, he’s filed another complaint with the Equal Employment Opportunity Commission against for discrimination for not just against the City, but the City Manager as well.
He just doesn’t get it.
Rod Jolivette had Albany firefighters, on the clock, tear out flood damage from his aunt and uncles house and then lied about it, trying to throw a junior officer under the bus in the process. Even if Jolivette’s description of events was accurate, he should have still been fired.
To refresh your memory, Jolivette claims that he asked for a mop and the firefighter in charge sent out a truck and firefighters to assist with the clean up. Jolivette argues this while proclaiming his “innocence”. This, Jolivette feels, should absolve him from any wrongdoing.
Of course, Jolivette is oblivious to the fact that as the number three firefighter in the department, he had the authority to tell the firefighters to go back to the station and to reprimand the firefighter who made that decision. He can’t seem to accept the fact that by whatever chain of events one chooses to believe, he’s still in the wrong. He screwed the pooch by any definition you want to use, and now he can’t stand up and say “my bad’.
Jolivette seems pathologically incapable of accepting responsibility for his mistakes though. It seems, at least to this outside observer, that he screams discrimination for every decision that doesn’t go his way. Now, I’m not fan of Al Lott, but the letter he sent to Jolivette laid out one hell of a case for termination against Jolivette and not one making a case of discrimination.
Rod. Buddy. Just accept that you screwed up and move on. Then, the next time you make the news, it might be for something that you and the rest of Albany can be proud of.
Do you know if this will have any effect on his 90-day probationary period?
Some people just can’t leave well enough alone, can they?
I believe that the law protects his right to file and there shouldn’t be any effect on his probationary period, but I’m not 100% certain.
However, he’s still poking a lion in the eye with sharp stick.
My understanding is that no retaliatory measures can be taken against him for filing his EEOC claim. I have no problem with that rule. In fact, I think the rule is a fair and wise one. People should not be intimidated from exercising their rights.
Please don’t misinterpret the above as any ratification of the merits of Mr. Jolivette’s claim. So far, my impression of him and his claim is less than favorable. I will await to learn his specific allegations before commenting further.
But back to the original question: Do not discount the possibility that the timing of his EEOC claim may have been a purposeful attempt to bait the city into taking retaliatory action. Then he would have actually have a grounded claim.
I agree that he shouldn’t be open for retaliatory actions after filing his claim. Rules have to be applied evenly to everyone, something I’ve said since this mess with Jolivette first started. Many came on here and claimed other firefighters did things just as bad, to which my answer was “fire them too!”
I wouldn’t be surprised in the least for Jolivette to be hoping to get hit with something so he can claim it’s in retaliation for his claim, just has he’s tried to claim his previous issue was. My sincere hope is that the City documents anything and everything he does prior to taking any action so that they can bounce him right out on his butt should he screw up during his probationary period.
Frankly, it’s ridiculous that he still has a job in the first place.
So I guess Mr. Jolivette is not grateful for the favor of being allowed a second chance.
In his mind, he’s still the victim. That’s what’s so sad about it.
I am shocked that this man is such a “I GOTTA SUE SUE SUE” person. I was able to find the lawsuit with the Marine base but none of the others. What kind of person acts this way, instead of being a stand up person and setting an example (positive one) for the youth in this area. And for such a religious man his kid has a terrible potty mouth, came across his myspace and bebo sites, this is a preachers son?
